Short-term rental ordinance fails to pass second reading - Park Rapids Enterprise

City Planner Andrew Mack introduced the second reading of the ordinance amendment establishing rules, permit fees and an application form for short-term rentals, such as Airbnb and Vrbo.

Invited to comment on the issue, local Realtors TJ Simon and Diane Dennis raised concerns about the ordinance.

First, Simon addressed the proposed ordinance’s buffering standard, requiring at least 500 feet of separation between short-term rental properties.

Acknowledging this was meant to prevent a “party row” situation, he said it would result in a property owner being unable to get a permit if someone else on their block got one first. Instead, he suggested enforcing nuisance issues with a “three strikes, you’re out” policy.

Second, Simon requested clarification about the clause prohibiting commercial or social events at short-term rentals. He wondered whether this would include people inviting friends over for a barbecue.

Mack explained that this clause was meant to encourage party planners to reserve commercial event spaces for such things as wedding receptions. Simon urged making the ordinance language more specific.

Third, both Simon and Dennis sought clarification about how a rental license and short-term rental permit would be affected by a property sale via contract for deed.

Council member Erika Randall moved to adopt the ordinance as presented, in order to allow council discussion of it. The council quickly reached a consensus to return the ordinance to the planning commission for further consideration and clarification.

Randall’s motion failed unanimously. Council member Liz Stone followed up with a motion to refer the issue back to the planning commission, which passed unanimously.

Mack told the council about how he thinks the planning commission can handle the concerns that Simon and Dennis brought forward.

He also advised the council that the planning commission will need to have a second public hearing at city expense regarding short-term rentals, to give the public an opportunity to comment while the ordinance is still in draft form.

“I think that’s understood,” said Randall, adding, “I appreciate the realtors speaking up and participating today, but just a reminder that there is an opportunity for public hearing rather than at this stage. I think we’re making the right decision, but that’s the purpose of a public hearing.”
