COLUMBIANA — Council members this week discussed short-term rentals. Members are in the process of drafting an ordinance affecting Airbnb, vacation and Vrbo rentals.

Municipal Attorney Mark Hutson pointed out the organizations affiliated with short-term rentals have not regulated the rentals as the public would like.

“It seems like it was about just the opposite,” Hutson said. “What communities have started doing, and even smaller communities such as ours, is actually trying to regulate the use of short-term rentals.”

Council does not intend to ban short-term rentals, but regulate where they are. Regulations can also restrict zoning districts, when short-term rentals can be operated, the number of short-term rentals within a district, parking and the number of people allowed to inhabit the rental property.

Council member Rick McBane raised concerns about legislation limiting bedroom occupation. Hutson agreed that the concerns are legitimate; however, the legislation is written in the context of limiting how many people are in the house.

“I know there are a lot of circumstances where college kids and others go out and rent and basically have a party. That is very bad for the local community,” McBane pointed out.

Hutson suggested council write the ordinance in a way that permits short-term rentals where such

activity was not allowed before.

Taking such action would remove complicated hurdles required to make any amendments or changes to zoning codes.

The idea is to encourage responsible behavior on the part of the landlord and renter. Council intends to require contact phone numbers and registration connected to short-term rental properties. The proposed regulations will prevent less than satisfactory short-term rentals and limit unsavory tenant behavior.

The Columbiana Planning Commission has proposed limitations restricting short-term rentals to commercial zones including, C1, C2, C3, C4 and C5.

“Me as a resident I wouldn’t want to have a new neighbor every weekend,” Council member Ted Souder commented.

Concerns among council include enforcing operating permits, violations and clear expectations.

Council does not intend to place additional restrictions on where bed and breakfasts can operate. Council will continue to allow bed and breakfasts to operate in residential zones.
